My Spouse is Outside the U.S.

A U.S. Citizen or Legal Permanent Resident may apply for permanent residence for his or her spouse.

How do apply for a green card for my spouse if he or she is outside the U.S.?

  1. Prepare the USCIS Forms.

    – USCIS Form I-130

  2. Gather the Required Supporting Documents:

    From the Petitioner (U.S. Citizen):
    – 2 Passport Style Photographs
    – Long Form Birth Certificate + English Translation if required
    – Current Passport Picture + Signature Page.
    – Naturalization Certificate if applicable
    – Permanent Resident Card (front and back) – if applicable
    – Documents Terminating Prior Marriages + English Translation if required
    – Marriage Certificate + English Translation if required
    – Proof of Joint Life
    – Photographs Together
    From the Beneficiary (Foreign National Spouse):
    – 2 Passport Style Photographs
    – Long Form Birth Certificate + English Translation if required
    – Secondary Evidence of Birth
    – Current Passport Picture Page + all U.S. Visas
    – Documents Terminating Prior Marriages + English Translation if required
